General provisions
These Regulations define the rules for the sale of Goods by mail order via the online store Orvicta sp. z o. o.
The online store is operated by Orvicta spółka z ograniczoną odpowiedzialnością with its registered office in Rydułtowy (ul. Marcina Strzody 119, 44-280 Rydułtowy), entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court in Gliwice, 10th Commercial Division of the National Court Register, under number 0000959121, REGON: 521430059, NIP: 6472597103, being both the Seller and the Service Provider of the Online Store.
Correspondence related to the services provided by the Seller within the Online Store should be sent to the following address: ul. Marcina Strzody nr 119, 44-280 Rydułtowy, or to the e-mail address: info@orvicta.com
Telephone contact with the Seller is possible at 513 030 119 on weekdays between 9:00 a.m. and 6:00 p.m.
Each Customer is obliged to read, familiarize themselves with and comply with the provisions of these Regulations at the time of taking steps to use the Store, i.e. before using or registering.
The customer is obliged in particular to:
using the Online Store in a way that does not disrupt its functioning,
using the Online Store in a way that is not burdensome for other customers and for the Seller,
use any content posted on the Online Store only for your own personal use,
use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland and the provisions of the Regulations.
The Customer is obliged to use the Online Store and electronic services provided through it in a manner consistent with the provisions of applicable law and the provisions of the Regulations, respecting the copyrights and intellectual property of the Seller and third parties. The Customer of the Online Store is prohibited from providing content of an illegal nature.
The Seller is the administrator of the personal data of Customers and users of the Online Store within the limits and on the principles specified in the Privacy Policy of the Online Store. The personal data of Customers and Users of the Store's website are processed on the principles specified in the Privacy Policy of the website based on the applicable provisions on the protection of personal data, the provision of services by electronic means, telecommunications law and other relevant legal provisions in this area.
Glossary of terms
Contact form – an interactive form enabling the User to contact the Service Provider;
Registration form – an interactive form enabling the creation of a Customer Account;
Order Form – an interactive form through which the Customer places an Order in the Online Store;
– a natural person with full legal capacity, a legal person or an organizational unit without legal personality, to which the law grants legal capacity, who has concluded or intends to conclude a Sales Agreement with the Seller and/or uses or intends to use the Electronic Service offered within the Store;
– an electronic service, marked with an individual password and login set by the Customer, containing data about the Customer and information about the Orders placed by him;
Civil Code – the Act of 23 April 1964 - the Civil Code (Journal of Laws of 2022, item 1360, as amended), hereinafter referred to as the "Civil Code";
– a natural person concluding a legal act with an entrepreneur that is not directly related to his or her business or professional activity;
– an electronic service provided by the Seller via e-mail, which enables Customers who use it to receive periodic and free information about new products and promotions offered via the Store;
– regulations of the Online Store operating at the website address www.orvicta.com ;
10.– movable items offered through the Store and constituting the subject of the Sales Agreement;
– a natural person, a legal person and an organizational unit that is not a legal person, conducting business or professional activity on its own behalf;
12.– Orvicta limited liability company with its registered office in Rydułtowy;
13.– online store operating under the domain orvicta.com, orvicta.eu, owned by the Seller;
14. The Goods are shipped to the Customer via courier companies: …………………..
15. Sales agreement – a sales agreement concluded between the Seller and the Customer at a distance via the Store, the subject of which are the Goods presented on the Store's website;
16. Distance contract - a contract concluded with the Client as part of an organised distance contracting system, without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the moment of conclusion of the contract.
17. Electronic service – a service provided without the simultaneous presence of the parties, by transmitting data at the individual request of the Client (service recipient), sent and received using devices for electronic processing, including digital compression, and data storage, which is entirely transmitted, received or transmitted via a telecommunications network;
18.– declaration of intent submitted by the Customer expressing his/her will to conclude the Agreement, in which the Customer specifies the quantity and type of Products ordered.
Electronic services offered
The Seller provides the following services electronically via the Store:
Registration form;
Contact form;
Order form;
Use of the above Electronic Services is free of charge.
In order to use the Electronic Services provided within the Online Store, the Customer's IT system should meet the following technical requirements:
the Customer's end device must have access to the Internet;
The customer must have access to email;
the web browser (e.g. Mozilla Firefox, Google Chrome, Internet Explorer, Opera, Safari, Microsoft Edge) must support cookies;
it is necessary to enable cookies and Javascript support in your web browser.
The Customer is responsible for the fees associated with access to the Internet in accordance with the tariff of his/her Internet service provider.
The Customer is obliged to enter personal data that is consistent with the actual state of affairs.
In the event of non-performance or improper performance of the Electronic Service by the Seller, the Customer is entitled to file a complaint under the terms and conditions set out in the Regulations (the complaint relates only to technical issues, such as non-functioning of the Account or forms).
Complaints related to the provision of Electronic Services within the Online Store or other complaints regarding the operation of the Store may be submitted by the Customer, for example, by traditional mail to the following address: ul. Marcina Strzody 119, 44-280 Rydułtowy, or to the following e-mail address: orvictastore@gmail.com
In the complaint, the Customer should indicate the circumstances relating to the subject of the complaint (e.g. date of occurrence and type of defect), specify his/her request and provide contact details of the person submitting the complaint.
The Seller shall take a position on the notification immediately, no later than within 30 days from the date of its receipt.
The Customer using electronic services of a continuous and indefinite nature (e.g. the Account service) may terminate the agreement for the provision of the Service without giving a reason, and the exercise of this right will take place after sending a declaration to the Seller in this regard.
The Seller reserves the right to terminate the agreement for the provision of the Account Service with a 7-day notice period in the event of a breach of the provisions of the Regulations.
The Seller shall not be liable, to the fullest extent permitted by law, for any disruptions, including interruptions in the functioning of the website caused by force majeure, unauthorized actions of third parties or incompatibility of the website with the Customer's technical infrastructure.
Contact form
The “Contact Form” electronic service is available in the “Contact” tab.
To use this service, the Customer is required to provide their name and surname, a valid e-mail address, and then fill in the subject and content of the message. You should also check the box with information about reading the Store Regulations and the Store Privacy Policy. After completing these steps, click the "Send" button.
The Agreement for the provision of the Service is concluded for a fixed period of time at the moment the Customer starts filling out the form and is terminated when the Customer stops filling it out or when the Seller provides a response.
Registration form and account
The electronic service "Registration Form" and "Account" is available when filling out the Order Form and in the "My Account" tab.
The Service can be used after providing an e-mail address and a password consisting of the appropriate number of characters.
The Agreement for the provision of the Service is concluded for an indefinite period of time at the moment of completing the Registration Form and providing a password consisting of an appropriate number of characters.
The condition for creating a Customer Account is the acceptance of the Store Regulations and Privacy Policy and the provision of personal data indicated in the Registration Form.
The Account service is concluded for an indefinite period and is terminated upon sending a request to delete the Account to the Seller's e-mail address.
The account is non-transferable.
Order form
The use of the electronic service "Order Form" is possible after adding the Product to the electronic basket available in the Store, and then providing the following data: name and surname, company name and Tax Identification Number (in the case of a request to issue a VAT invoice), address of residence/registered office/business activity/delivery (street, building number, apartment number, city, country), telephone number, valid e-mail address, indicating the method of delivery/collection of the Goods and the payment method, and clicking the button confirming the placement of the Order and the need to pay the price.
The Agreement for the provision of the Service is concluded for a fixed period of time at the moment of adding the first Product to the electronic basket and is terminated at the moment of clicking the button confirming the placement of the Order and the need to pay the price or at the moment of refraining from filling in the Form.
Newsletter
The Agreement for the provision of the Service is concluded for a fixed period of time at the moment of adding the first Product to the electronic basket and is terminated at the moment of clicking the button confirming the placement of the Order and the need to pay the price or at the moment of refraining from filling in the Form.
“Newsletter” electronic service: available for selection in the Registration Form and the Order Form.
The Service can be used after providing a valid e-mail address and checking the box to subscribe to the Newsletter.
The Agreement for the provision of the Service is concluded for an indefinite period of time at the moment of clicking the button confirming the order for the Newsletter and is terminated at the moment of unsubscribing.
The Customer may resign from the Service at any time by clicking the resign link contained in each newsletter message or by unchecking the newsletter subscription checkbox in the Customer Account administration panel.
The Newsletter is sent only to persons who have subscribed to the Newsletter.
Use of the Service is free of charge.
Orders

Zamieszczone na stronie internetowej Sklepu informacje nie stanowią oferty, lecz zaproszenie do zawarcia umowy w rozumieniu art. 71 kc.

Ceny Towarów wyrażone są w złotych polskich i zawierają podatek VAT.

Cena podana przy każdym Produkcie w chwili złożenia zamówienia przez Klienta jest wiążąca, a zmiana ceny Produktu po złożeniu Zamówienia przez Klienta, nie ma wpływu na wysokość ceny Zamówienia.

Ceny nie obejmują kosztów związanych z wysyłką zamówionych Towarów. Koszt wysyłki zostanie doliczony do wartości Zamówienia w zależności od wybranego sposobu wysyłki lub odbioru Towaru.

Sprzedawca umożliwia następujące sposoby dostawy lub odbioru Towaru przez Klienta:

przesyłka kurierska;

przesyłka do paczkomatu;

Wysyłka Towarów do Klienta odbywa się za pomocą firm kurierskich : IN POST

Koszt wysyłki Towarów uzależniony jest od sposobu dostawy wskazanego przez Klienta. Koszty dostawy każdorazowo są wskazywane w procesie składania Zamówienia.

Zawarcie Umowy sprzedaży między Klientem a Sprzedawcą następuje uprzednim złożeniu Zamówienia przez Klienta za pośrednictwem Formularza zamówienia.

W celu złożenia Zamówienie nie jest wymagana rejestracja w Sklepie internetowym.

Warunkiem niezbędnym do złożenia Zamówienia drogą elektroniczną jest posiadanie poczty elektronicznej, prawidłowe wypełnienie Formularza zamówienia oraz akceptacja treści Regulaminu Sklepu i Polityki Prywatności.

Zamawiający w chwili składania Zamówienia obowiązany jest do podania następujących danych: imienia, nazwiska, lub nazwy firmy i numeru NIP (celem wystawienia faktury VAT), adresu zamieszkania, siedziby lub miejsca prowadzenia działalności gospodarczej, adresu dostawy (jeśli jest inny niż adres zamieszkania/siedziby/miejsce prowadzenia działalności gospodarczej), numeru telefonu oraz adresu mailowego, jak i wyboru sposobu dostawy lub odbioru Towaru oraz metody płatności.

Sposób płatności jest wybierany przez Zamawiającego spośród następujących form oferowanych przez Sprzedawcę:

płatności elektronicznej za pośrednictwem systemu płatności elektronicznych Przelewy24 (dostępne metody płatności zostały opisane na stronie usługodawcy pod adresem: https://www.przelewy24.pl/metody-platnosci);

Informacje o złożonym Zamówieniu, w szczególności o zamówionych Towarach, łącznej cenie, sposobie i kosztach dostawy oraz sposobie zapłaty, zostaną przesłane na podany przez Zamawiającego adres mailowy.

Umowę uznaje się za zawartą z chwilą otrzymania przez Klienta potwierdzenia złożenia Zamówienia, o którym mowa w ustępie powyżej.

10.Dokumentem potwierdzającym sprzedaż Produktów jest faktura VAT lub rachunek.

Czas realizacji zamówienia zależy od dostępności towarów w magazynach producentów i wynosi standardowo od 1 do 14 dni roboczych. Okres realizacji zamówienia ulega wydłużeniu w przypadku towarów wykonywanych na zamówienie, o czym Klienta jest informowany w opisie produktu oraz mailowo.

12.Zamawiający powinien sprawdzić stan przesyłki w obecności pracownika firmy kurierskiej.
W przypadku stwierdzenia uszkodzenia należy sporządzić protokół szkody na druku firmowym firmy kurierskiej i skontaktować się niezwłocznie ze Sprzedawcą. Jeśli rzecz jest uszkodzona, prosimy o nieprzyjmowanie przesyłki. -
13.W przypadku Klientów będących Przedsiębiorcami Sprzedawca nie ponosi odpowiedzialności za utratę lub uszkodzenie przesyłki z chwilą wydania Towaru wybranemu przez Klienta przewoźnikowi.

14.Sprzedawca odmawia realizacji Zamówienia w następujących przypadkach:
-
Klient wskazał niekompletne dane, które uniemożliwiają realizację złożonego zamówienia.
-
Towar, po złożeniu zamówienia, został wycofany z obrotu bądź wstrzymany w obrocie na terenie Rzeczpospolitej Polskiej.
-
Sprzedawca nie ma możliwości zrealizować zamówienia złożonego przez Klienta (incydentalna niezgodność stanów magazynowych bądź incydentalne uszkodzenie towaru).

W przypadkach wymienionych w ust. 19, Sprzedawca zobowiązany jest niezwłocznie (w przeciągu 3 dni roboczych) licząc od dnia złożenia zamówienia, powiadomić o tym Klienta drogą elektroniczną lub telefoniczną. Jeśli Klient uiścił już zapłatę za złożone zamówienie, Sprzedawca zobowiązuje się zwrócić pełną kwotę w przeciągu 5 dni roboczych licząc od dnia złożenia zamówienia.
Right of withdrawal
In the case of distance and off-premises contracts, the Consumer has the right to withdraw from the Sales Agreement within 14 days without giving any reason.
The Consumer may withdraw from the Sales Agreement by submitting a declaration of withdrawal from the Agreement to the Seller. To meet the deadline for withdrawal from the Agreement, it is sufficient for the Consumer to send the declaration before the deadline expires.
The declaration may be sent by traditional mail or electronically by sending the declaration to the Seller's e-mail address - the Seller's contact details are specified in point I.
If the Consumer sends the declaration electronically, the Seller shall immediately send the Consumer a confirmation of receipt of the declaration of withdrawal from the Agreement to the e-mail address provided by the Consumer.
Consequences of withdrawal from the Sales Agreement:
in the event of withdrawal from the Contract concluded at a distance, the Contract is deemed not to have been concluded;
in the event of withdrawal from the Agreement, the Seller shall immediately return to the Consumer, no later than within 14 days from the date of receipt of the Consumer's declaration of withdrawal from the Agreement, all payments made by him, including the amount of the prepayment, if made by the Customer, subject to paragraph 7.
the Seller will refund the prepayment using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer has expressly agreed to another solution that will not involve any costs for him,
The consumer is obliged to return the Goods to the Seller or to hand them over to a person authorized by the Seller to collect them immediately, but no later than 14 days from the day on which he withdrew from the contract, unless the Seller has offered to collect the goods himself. To meet the deadline, it is sufficient to send the goods back before it expires. The consumer bears only the direct costs of returning the goods.
If the Consumer has chosen a method of delivery of the Goods other than the cheapest standard method of delivery offered by the Seller, the Seller is not obliged to refund the additional costs incurred by the Consumer.
The right to withdraw from a distance contract does not apply to the Consumer in relation to the Contract:
where the subject of the provision is a non-prefabricated item, manufactured according to the Consumer’s specifications or intended to meet their individual needs,
where the subject of the service is an item delivered in a sealed package which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery;
where the subject of the service is an item that spoils quickly or has a short shelf life;
for the provision of services, if the Seller has fully performed the service with the express consent of the Consumer, who was informed before the commencement of the provision that after the Seller has performed the service, the Consumer will lose the right to withdraw from the Agreement;
in which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the deadline for withdrawal from the Agreement expires;
where the subject of the provision are things that after delivery, due to their nature, are inseparably connected with other things;
Withdrawal from the contract, as provided for in paragraphs 1-7 above, is available only to the Customer who is a Consumer or an Entrepreneur who is a natural person concluding a contract directly related to his/her business activity, in a situation where this contract does not have a professional character for this Entrepreneur. In the case of Entrepreneurs who have concluded a Distance Sale Agreement with the Seller via the Online Store, the right to submit a declaration of withdrawal from the distance contract without giving a reason does not apply.
The consumer is liable for any reduction in the value of the item resulting from using it in a way that goes beyond what is necessary.
Complaints and warranty
The Seller is obliged to deliver the Buyer a defect-free item. The Seller is liable to the Buyer if the sold item has a physical defect (non-conformity of the item with the Agreement) or a legal defect.
In the event of defects in the Product, the Consumer has the right to exercise
from the rights arising from the warranty for defects in the sold item in accordance with the provisions of the Civil Code (Article 556 et seq. of the Civil Code).Complaints should be submitted to the following address of the Seller: ul. It is recommended that the Consumer inform the Seller about the detected defect within 14 days of its discovery.
The Seller shall respond to complaints within 14 days of receiving them. Failure by the Seller to respond within the above period means that the Seller has deemed the complaint justified. If it is not possible to consider the complaint within the above period, e.g. due to the need for the Buyer to deliver the Goods or the need to examine them, the Seller shall inform the Buyer of the above before the expiry of 14 days from the date of receiving the complaint.
By making use of the warranty, the Consumer may, under the terms set out in the Civil Code:
submit a declaration of price reduction,
in the case of a significant defect - submit a declaration of withdrawal from the contract,
demand the replacement of the item with a defect-free one,
demand removal of the defect.
A consumer who exercises warranty rights is obliged to deliver the defective Product to the Seller's registered office at the Seller's expense.
In accordance with Article 558 § 1 of the Civil Code, the Seller's liability under the warranty for the Product towards a Customer who is not a consumer is excluded.
If the Product is covered by an additional warranty, information about it and its terms is available in the product description in the Store.
Extrajudicial methods of handling complaints and claims

A customer who is a consumer has the possibility to use out-of-court methods of handling complaints and pursuing claims, including using an amicable consumer court, a consumer ombudsman or other public organizations.
Final provisions
The Seller reserves the right to make changes to the Regulations at any time. The change to the Regulations does not affect contracts in progress. The change to the Regulations shall enter into force
enters into force at the moment of its publication on the Store's website.In the case of concluding contracts of a continuous nature, such as the Customer Account service, the amended Regulations are binding on the Customer who has been properly notified of the changes and has not terminated the contract within 7 calendar days from the date of notification.
Any disputes that may arise in connection with this agreement shall be resolved by a competent Polish court.
In the event of a dispute arising from the concluded Sales Agreement or Electronic Services Agreement, the parties will strive to resolve the matter amicably. The law applicable to the resolution of any disputes arising from these Regulations is Polish law.
The regulations enter into force on 01/09/2022.
